Hari Raya, Popular Book Fest, School Holidays- 20% Discount

1. Brain Bytes Sdn Bhd ROC NUMBER 6667264H will be referred to as (“Brain Bytes”).

THE PROGRAMME PERIOD
2. The “Hari Raya, Popular Book Fest, School Holidays- 20% Discount
” (“Promotion”) shall run from 16August 2011 to 4 September 2011, both dates inclusive (“Promotion Period”).

ELIGIBILITY
3. This Promotion is open to all subscribers for the following products:-
a. MathsWiz : Primary
b. MathsWiz : Middle
c. MathsWiz : Secondary
d. English Wiz : Primary
e. English Wiz : Middle
f. English Wiz : Secondary

Registration criteria:
4. To participate in this Promotion, the Eligible Subscribers need only to subscribe any of the products listed in clause 3 above within the promotion period.

5. Upon successful subscription, the Eligible Subscriber will receive a confirmation via email sent by ipay88. Such confirmation will be sent to the email address used for the subscription and the confirmation email will sent at no cost.

6. Upon successful subscription as per Clause 5 above, the Eligible Subscriber must agree that their credit cards may have to be charged on a monthly recurring basis until cancellation notice has been sent to info@brainbytes.org at least 1 week before cancellation is to be effective.

The Offer
7. The Eligible subscriber stands to purchase products listed in clause 3 at 20% discount of the Real Retail Price (RRP) within the promotion period. The promotion package discounted prices are fixed as below:-
a. MathsWiz : Primary @ RM48
b. MathsWiz : Middle @ RM72
c. MathsWiz : Secondary @ RM96
d. English Wiz : Primary @48
e. English Wiz : Middle @RM72
f. English Wiz : Secondary @RM96

8. The Elligible Subscriber will be charged at the discounted purchase price even after promotion period (After 4th September 2011) as long as the first purchase is made within promotion period and payments are made continuously. Sign-ups during the promotion period will entitle subscribers to enjoy the discounted rate until they decide to discontinue.

9. Brain Bytes will not entertain any request from any Eligible Subscribers or any other person to transfer the promotion package listed in clause 8 to the Eligible subscriber’s other or any third party.

10. Brain Bytes shall not be held liable for any mishaps, injuries or accidents that may occur in the usage of the products received in this Promotion.

General Terms and Conditions

11. Brain Bytes reserves the right to substitute the product with any other products or item of similar value at any time with 3 days prior notice.

12. Selected Eligible Subscribers / Winners of competitions will receive an agreement via email from Brain Bytes before any personal information is published. Agreement via email includes:- Brain Bytes reserves the right to publish or display the name, picture and city of residence of the Eligible Subscribers who has been selected to receive the benefits for this Promotion for advertising and publicity purposes. By electronically signing/agreeing to this agreement from Brain Bytes, the selected Eligible Subscribers hereby consent to and agree that Brain Bytes shall be at liberty to publish their names, pictures and city of residence without compensation for advertising and publicity purposes.

13. By participating in this Promotion, the Eligible Cardholder agrees to be bound by these Terms and Conditions and the decisions of Brain Bytes.

14. Brain Bytes’s decision on all matters relating to this Promotion including but not limited to the eligibility to participate, the selection of the recipient for this Promotion, and in case of any dispute, shall be final and binding on all Eligible Subscribers of this Promotion and no correspondence will be entertained.

15. Brain Bytes reserves the right at its absolute discretion to vary, delete or add to any of these Terms & Conditions with 3 days prior notice.

16. These Terms and Conditions, as the same may be amended from time to time pursuant to Clause 15, shall prevail over any provisions or representations contained in any other promotional materials advertising this Promotion.

17. Brain Bytes may use any of the following modes to communicate notices in relation to this Promotion to the Eligible Subscriber:

i) individual notice to the Eligible Subscriber (whether by written notice or via electronic means)

sent to the Eligible Subscriber’s latest address/email address as maintained in the Brain Bytes’s records;

ii) press advertisements;

iii) notice in the Eligible Subscriber’s statement(s) if any;

iv) notice on Gooroo and/or Brain Bytes internet website(s);

where such notices shall be deemed to be effective on and from the 4th day after its delivery/publication/display as per the manner described herein. Save and except notices sent via ordinary mail which will be deemed delivered on the 3rd day after posting, notices sent via other modes as described herein are deemed delivered immediately after posting/publication/display.
18. These Promotion Terms and Conditions are in addition to the respective Terms and Conditions (“T&Cs”) for Brain Bytes of which the respective Subscriber Agreements are a part of and which regulate the provision of services and facilities offered by Brain Bytes. In the event of inconsistency between these Promotion Terms and Conditions and the T&Cs, these Promotion Terms and Conditions shall prevail in so far as they apply to this Promotion.

19. Brain Bytes shall not be liable for any default due to any act of God, war, riot, strike, terrorism, epidemic, lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of Brain Bytes.

20. Brain Bytes reserves the right to cancel, terminate or suspend this Promotion with 3 days prior notice. For the avoidance of doubt, cancellation, termination or suspension by Brain Bytes of this Promotion shall not entitle the Eligible Cardholder/potential winners/winners to any claim or compensation against Brain Bytes for any and all losses or damages suffered or incurred by the Eligible Subscriber/potential winners/winners as a direct or indirect result of the act of cancellation, termination or suspension.

21. In no event will Brain Bytes be liable for any losses or damages (including without limitation, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any part including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Promotion, even if Brain bytes has been advised of the possibility of such damages in advance, and all such damages are expressly included.

22. The Eligible Subscriber under this Promotion shall be personally responsible for all taxes, rates, government fees or any other charges that may be levied against them under applicable laws, if any, in relation to this Promotion.
